British Airways Christmas strike Q&A
Possible staff walkout 22 Dec - 2 Jan

More than 1m passengers face travel misery after British Airways (BA) cabin crew announced a 12-day strike. Here's a quick Q&A.

  • Can you get a flight refund? BA hasn't yet announced flights are cancelled (as at 10pm Tue), and until it does, you can't get a full refund. Meanwhile, for all but fully flexible tickets, it'll only allow you to change flight dates to the same destination; call 0844 493 0787, though its lines may be jammed (see BA stalls on refunds MSE News).

  • How about booking another flight? While it may be possible to find another flight (use Kayak* or Travelsupermarket*, full info with the Cheap Flights guide), until BA says flights are cancelled, you risk paying for two flights if the strike's called off / your flight is still on.

  • Can you reserve a flight elsewhere until BA cancels? Most travel agents only allow this when booking months ahead. You can ask a friendly agent, though it won't be easy (pls report successes below).

  • Should you cancel your hotel? Some allow cancellation with a full refund if done early enough. Check out the last refundable cancellation date so you can make the call as late as possible.

  • Will travel insurance cover you? If BA cancels flights it'll give your money back, but not hotel costs (unless booked via BA). Some travel insurers will cover you for non-refundable hotel / car hire already paid if you bought it & the cover before 14 Dec (strike announced) or 2 Nov (when the unions first met staff). It varies per insurer, though Aviva, Churchill and Direct Line may cover before 14 Dec. In a nutshell, call your insurer and ask.

  • Are credit card payments over £100 covered (Section 75)? If you booked a hotel / car hire separately it's unlikely Section 75 will cover you as the hotel / car firm hasn't done anything wrong.

  • Booked via a travel agent / tour operator or a package? According to ABTA, the Package Travel Regulations 1992 mean you'll usually get a full refund (hotel & travel) or be given a suitable alternative.

New legal arguments could mean banks must prove charges are fair
We know bank charges are unfair, even the Office of Fair Trading's (OFT) virtually said so. The problem's finding a law which says fairness matters. Recently on a technicality, the Supreme Court overturned an attempt to judge fairness based on one narrow regulation. So we engaged a top banking QC to investigate other legal routes & he's now reported back. New Reclaiming Guide: This includes the blockbuster new legal argument that, under the Consumer Credit Act, not only must bank charges be fair, but it's for the banks to prove they're fair, not for consumers to disprove. Next Step: We've provided the OFT, that took the original case, with these new arguments and need it to keep fighting; if not, the only option may be individuals arguing in court against the banks' barristers. Political support: Lib Dem leader Nick Clegg's calling on the OFT to follow our legal option & and in this instance the Tories believe it should launch a competition investigation. QUESTION OF THE WEEK

Q. Following my company's liquidation I've been forced to declare myself bankrupt. I need a bank account, obviously with no credit, but all the major banks have refused my applications?  Eugene by e-mail

A: Sadly, over 1m people in the UK are thought to be unbanked.  Worse still is that provided you've got ID (without it it's a nightmare) you should be able to get an account. Simply go to your bank and ask for a 'Basic Bank Account', specially designed for those with very poor credit scores.

Yet I suspect banks only offer them as a sop to social responsibility and disgracefully, unless you ask for them by name, specifically even if you tell them you've got a poor credit, they'll just give you a normal bank account form and then reject it.

Anecdotally, I'd suggest trying Barclays or the Co-op bank, who tend to be more accommodating than most. See the FSA Basic Bank Accounts PDF Guide for more.  Alternatively if you're lucky enough to be in an area with a Credit Union that offers a current account that's usually even better.
