Bank Charges Reclaiming - the campaign continues...
We've engaged a top banking QC to redraft the template letters

Last week the Supreme Court ruled on a technicality that the OFT couldn't decide whether bank charges were fair or not (see BC result news). Yet a glimmer of hope for reclaimers was offered by the chief Judge, Lord Phillips. Read this quick Q&A...

Q. Why did it fail? The Supreme Court decided bank charges are a core part of a bank account's price rather than a lesser part, and that technicality was bizarrely enough to stop them being assessed for fairness based on the specific law.

Q. What's the hope? The court said this didn't stop people challenging unfairness 'on other grounds', specifically clause 5 of the same regulations. And we're working on this, see my Bank Charges New Argument explanation.

Q. What happens next? The Office of Fair Trading who took the case against the banks won't decide what it'll do until Dec. Meanwhile to help the million plus people with cases on hold, we've engaged a top QC who usually works for the banks to rewrite our template letters (see MSE hires top QC news).

Q. What should reclaimers / those wanting to reclaim do? The full answer for every category (on hold at bank/ ombudsman/ court etc) is in my Bank Charges: the next steps Q&A. Meanwhile we're rushing to get the new letters out within the next ten days, more info via this weekly email next week.

Q. What are the chances? The new arguments may yet win, yet it's going to be tough, maybe a 10-20% chance only. So it's safest to plan your finances on getting nothing. But cross your fingers it works!

New Top 3.5% AER Cash ISA
Get 3.5% AER fixed for a year (min £500) and you can transfer past years' cash ISAs in too.

A cash ISA is simply a savings account you can put £3,600 in per tax year (£5,100 for over 50s) and you don't pay tax on the interest. New Top Deal: Northern Rock's new ISA pays 3.5% AER fixed for a year, if you've £500+. You can withdraw cash early, though you pay 60 days' interest as a penalty. It will also allow you to transfer money in from existing old cash ISAs from previous years. Top easy access: Standard Life's cash ISA pays 2.65% AER and you can withdraw cash penalty free, alternatively if you've over £9k in past years ISAs, Abbey's* online direct ISA lets you transfer them in at 3% AER easy access. Beat Ryanair's new £10 Visa Electron booking charge!
Budget airline adds £10 return to Electron bookings - but there's a new way to book for free
While Ryanair advertises flights for pennies (see below for this week's '£5' e/w sale), there are hideous add-on costs, including up to £10/return for most paying by credit & debit cards. What's the change? The current way to pay for free is with a Visa Electron card - but outrageously, from 1 Jan it'll move the goalposts and charge £10 return on these too. Beat the charges: Yet from 1 Dec. it won't charge for bookings using Mastercard Prepaid cards (no surprise as it's launched its own one in Ireland; maybe coming here?). The cheapest of these is ICE's Sterling Card* (choose the UK pound version) which is available free, and only charges 2% when you top up (min £100) though you can spend that anywhere. Q. Any way to get free calls to 0800 and 0900 numbers or premium phone numbers on my mobile? Alistair, by email

Martin's A: While 0800 numbers are meant to be freephones they're not on most mobiles, yet there's a nifty site which gives you a special number to dial first then call for free see the 0800Buster guide.

As for Premium numbers, nope they're often use to pay for services like competitions & chat lines and can cost up to £1.50/min. We've not seen any legal way to cut the cost (apart from not calling) if you have please tell us via the discussion.
